Empira debt collection for private parking charges

Empira is a member of the International Parking Community’s Accredited Service Provider scheme and provides private parking charge recovery and litigation support.

A private parking charge is not the same as a council-issued Penalty Charge Notice or a criminal fine. It is generally a civil claim based on the alleged terms for parking on private land.

At ordinary collection stage, Empira can contact you and request payment, but it cannot take goods. Formal enforcement would normally require a court judgment, the appropriate warrant or writ, a Notice of Enforcement and an authorised enforcement process.

Do not confuse a private parking collection letter with a Notice of Enforcement. However, do not ignore a Letter of Claim, County Court claim form, judgment or enforcement notice.

Empira Notice of Enforcement

A formal Notice of Enforcement is different from an ordinary demand or parking collection letter.

It should identify the debtor, creditor, debt, enforcement power, amount due, payment methods, Empira reference and deadline before an enforcement agent attends.

Under the usual taking-control-of-goods procedure, the debtor must receive at least seven clear days’ notice, excluding Sundays and bank holidays, unless a court permits a shorter period.

What can Empira enforcement agents take?

Where Empira has valid taking-control-of-goods authority, an agent may control non-exempt goods owned by the debtor.

Essential household items, qualifying work tools, disability equipment, domestic pets and goods owned wholly by another person are protected or outside the debtor’s ownership.

A debtor-owned vehicle can be at risk even if no one enters the home. Finance, third-party ownership, disability use and the statutory work exemption should be evidenced immediately.

For relevant taking-control-of-goods instructions received on or after 1 May 2026, the revised statutory fixed fees and percentage threshold apply. Older instructions can remain under the previous scale.

What if the Empira debt is wrong or belongs to someone else?

Empira’s own guidance says it will continue formal enforcement until the court withdraws the warrant or payment is made. An urgent legal challenge therefore needs to be made through the correct court or statutory route, not only by emailing Empira.

Ask for reasonable adjustments and review

Empira and vulnerable customers

Vulnerability can arise from physical or mental illness, disability, age, bereavement, pregnancy, domestic abuse, communication difficulties, recent trauma or severe financial hardship.

Empira states that its staff are welfare trained and that it seeks to identify and support vulnerable customers throughout the enforcement process.

Explain the circumstances, how the enforcement is affecting you, what adjustment is required and whether a representative should be authorised to assist.

Vulnerability does not automatically cancel the debt. It can require the enforcement method, contact and payment expectations to be reviewed and reasonable adjustments to be considered.

Empira’s procedure says written complaints should be acknowledged within five working days and aims for a substantive response within 20 working days. An appeal must be requested in writing within 14 days of the initial response.

Empira can act in more than one capacity. The correct action depends on the debt and stage. Options can include paying, obtaining a written instalment arrangement, challenging a liability or court error, proving goods belong to someone else, reporting vulnerability, obtaining Breathing Space or considering whether a formal debt solution affects the debt.

Empira provides an online account facility, a 24-hour automated payment line and customer-service contact. Whether instalments are accepted depends on the client, debt and enforcement stage. Ask for written confirmation of the agreed amount, dates and whether enforcement is suspended.

For ordinary Council Tax, business rates at a home address, parking-related civil debts and most civil judgments, an agent cannot normally force entry into a residential property on a first visit. Different rules can apply to certain court fines, commercial premises or lawful re-entry after goods have already been controlled.

Where Empira is carrying out formal enforcement, a debtor-owned vehicle can be clamped or removed if it is not exempt. Evidence may be needed if it belongs to another person, is subject to finance, is used for disability needs or falls within the work-tools exemption.

For relevant instructions received on or after 1 May 2026, the main fixed taking-control-of-goods fees are £79 at compliance, £247 at enforcement and £116 at sale or disposal. A 7.5% percentage fee can apply to the part of the principal debt above £1,900 at the enforcement and sale stages. Older instructions can use the previous fee scale.

Raise the dispute with Empira and the original creditor, parking operator, council or court and provide evidence. Empira states that formal enforcement can continue until the court withdraws the warrant or the debt is paid, so use any required appeal, set-aside or court process urgently.
