What to do after an Equita Notice of Enforcement

For relevant enforcement using the Schedule 12 taking-control procedure, Equita must normally provide at least 14 clear days’ notice before goods are taken into control. Sundays, bank holidays, Good Friday and Christmas Day are excluded from the clear-day calculation.

A qualifying debt-advice provider can request an extension so the period becomes 28 clear days for an eligible non-business debt. The request must be made before the original notice period expires.

Use this stage to verify the debt, resolve an error, report vulnerability and negotiate. A visit can add the enforcement fee.

For Council Tax, parking penalties and most ordinary civil enforcement at a home, Equita agents cannot normally force entry on a first visit. Keep doors locked and communicate without allowing entry. Different rules can apply to business premises, lawful re-entry after goods have been controlled and certain debts with stronger statutory powers.

A vehicle owned by the debtor can potentially be clamped or removed during valid enforcement if it is not exempt. Send evidence urgently if it belongs to someone else, is on finance, is used for qualifying disability needs or is essential for work within the statutory exemption.

For relevant Schedule 12 enforcement, Equita must normally give at least 14 clear days' Notice of Enforcement before taking control of goods. For a qualifying non-business debt, an authorised debt adviser may request an extension to 28 clear days before the original notice period expires.

For relevant instructions received on or after 1 May 2026, the standard fixed fees are £79 at compliance, £247 at enforcement and £116 at sale or disposal. A 7.5% percentage fee can apply to the part of the principal debt above £1,900 at the enforcement and sale stages. Older instructions may use the previous scale.

Contact Equita promptly and explain that the named person does not live at the address or use the telephone number. Provide reasonable evidence of your identity or occupancy if requested, and retain proof that valuable goods and vehicles belong to you.

First identify whether the letter concerns a council Penalty Charge Notice or a private parking charge. A council warrant may require a Traffic Enforcement Centre witness-statement or statutory-declaration procedure if earlier documents were not received. A private parking debt normally needs a court judgment before bailiff enforcement.

Equita's welfare contact is listed as welfare@equita.co.uk by a current council page. Report illness, disability, mental-health difficulties, pregnancy, bereavement, domestic abuse, communication needs or severe hardship immediately and explain the adjustment or suspension needed.

Complain in writing to Equita and the creditor, such as the council, with the case reference, timeline, evidence and remedy sought. A complaint does not automatically stop enforcement, so request a separate hold. Equita is accredited by the Enforcement Conduct Board, which may consider eligible unresolved conduct complaints after the firm's process.

Breathing Space can temporarily pause most enforcement for a qualifying notified debt after an authorised debt adviser starts the moratorium. An approved IVA can bind creditors for qualifying debts. Neither option necessarily releases goods already controlled or covers every debt, so the debt and enforcement stage must be checked.
